Despite seeming uniformity in the law, end-of-life controversies have highlighted variations among state brain death laws and their interpretation by courts. This article provides a survey of the current legal landscape regarding brain death in the United States, for the purpose of assisting professionals who seek to formulate or assess proposals for changes in current law and hospital policy. As we note, the public is increasingly wary of the role of organ transplantation in determinations of death, and of the variability (...) of brain death diagnosing criteria. We urge that any attempt to alter current state statutes or to adopt a national standard must balance the need for medical accuracy with sound ethical principles which reject the utilitarian use of human beings and are consistent with the dignity of the human person. In this paper, I argue that causal theories of memory are typically committed to two independent, non-mutually entailing theses. The first thesis pertains to the necessity of appropriate causation in memory, specifying a condition token memories need to satisfy. The second pertains to the explanation of memory reliability in causal terms and it concerns memory as a type of mental state. Post-causal theories of memory can reject only the first (weak post-causalism) or both (strong post-causalism) theses. Upon this backdrop, I (...) examine Werning’s (2020) causalist argument from probabilistic correlation. I argue that it doesn’t establish the necessity of appropriate causation and thus it can only target strong post-causalist theories. I end up by presenting some general considerations, suggesting that memories may not always be causally linked to past experiences. (shrink)

Debates about causation have dominated recent philosophy of memory. While causal theorists have argued that an appropriate causal connection to a past experience is necessary for remembering, their opponents have argued that this necessity condition needs to be relaxed. Recently, Jordi Fernández has attempted to provide such a relaxation. On his functionalist theory of remembering, a given state need not be caused by a past experience to qualify as a memory; it only has to realize the relevant functional role in (...) the subject’s mental economy. In this comment, I argue that Fernández’s theory doesn’t advance the debate about memory causation. I propose that this debate is best understood as being about the existence of systems, which support kinds of interactions that map onto the relations dictated by theories. Since Fernández’s functionalism tells us very little about this empirical question, the theoretical gains from endorsing it are minimal. (shrink)

Slavná kniha Elementární formy náboženského života francouzského sociologa Émile Durkheima je jedním z nejdůležitějších příspěvků k sociologii náboženství. Po řadu let byla vychvalována a citována, stejně jako kritizována a zavrhována. Kniha se stala chartou celé řady sociálně vědních badatelů, zejména těch, kteří se zaměřovali na studium společnosti a náboženství. V roce 1966 však vyšel článek amerického antropologa Clifforda Geertze nazvaný „Nábo- ženství jako kulturní systém", v němž autor tvrdil, že Durkheimova teorie náboženství, stejně jako teorie náboženství Sigmunda Freuda, Bronislawa Malinowského (...) a Maxe Webera, by měla být překonána dokonalejší teorií náboženství. Touto dokonalejší teorií měla být Geertzova teorie. Porozuměl však Geertz Durkheimově teorii dostatečně, aby nás to opravňovalo k tvrzení, že Durkheim byl na poli teorie náboženství překonán? This paper presents scientists’ understanding of their roles in society and corresponding responsibilities. It discusses the researchers’ perspective against the background of the contemporary literature on scientific responsibility in the social sciences and philosophy and proposes a heuristic that improves the understanding of the complexity of scientific responsibility. The study is based on qualitative interviews with senior scientists. The presented results show what researchers themselves see as their responsibilities, how they assume them, and what challenges they perceive with respect to (...) their responsibilities. Regarding the latter, the interviewed researchers highlight those aspects of responsibility that go beyond the expertise of their professional role, and thus cannot be carried by scientists alone. For example, scientists alone cannot determine the general direction science takes, or the useful application of their research. The interviewed researchers describe those challenges as responsibilities that must be shared across different societal groups. In the theoretical literature, responsibility has been described as a relation between an actor (who), the action for which someone is responsible (what), and the normative framework against which someone is responsible (why). We will draw on this concept of “relational responsibility” to identify the various actors, normative frameworks, and actions relevant to scientific responsibility. This will serve as a heuristic tool to help identify the entanglement of responsibilities spread across several societal groups. (shrink)

According to contextualist accounts, the truth value of a given knowledge ascription may vary with features of the ascriber's context. As a result, the following may be true: "X doesn't know that P but Y says something true in asserting 'X knows that P'". The contextualist must defend his theory in the light of this unpleasant but inevitable consequence. The best way of doing this is to construe the context sensitivity of knowledge ascriptions not as deriving from an alleged indexicality (...) of the word "know" nor from its vagueness or ambiguity, but rather from a distinct semantic feature of the word "know", namely its unspecificity. Zamah neoplatonističkih koncepcija i oživljavanje ideala antike uz zdušnu potporu petrarkističke lirike, u humanizmu i renesansi uzvisuju ženu na način nepojmljiv za srednjovjekovlje. Dubrovačko zakonodavstvo, već od ranije pod prevladavajućim utjecajem Crkve, bilježi značajne promjene u pozicioniranju žene u društvu, dok nove misaone orijentacije snažno utječu i na kulturni život. Tako se u Dubrovniku pojavljuju i prve pjesnikinje, a konstruira se i prvi mit o ženi, onaj o Cvijeti Zuzorić. Upravo njen suvremenik i dragi prijatelj Nikola Vitov Gučetić, svojim radovima (...) svjedoči novu mogućnost – ženski glas uklopljen u filozofski koncept i promoviran potpisom uglednog Dubrovčanina. Gučetić otvara prostor svog ljetnikovca, zaštićenog mjesta za »časna proučavanja«, dvjema ženama za njihove razgovore o ljepoti i ljubavi, a posvetu objavljenim Dijalozima upućuje još jednoj »vrlo dičnoj i prepoštovanoj gospoji«, Cvijetinoj sestri Niki. Time svojoj supruzi Maruši Gundulić i Cvijeti Zuzorić posredovano daje glas, ali i ime. U stilskom susretu pjesničkog i filozofskog, prožimanju aktera i interpretatora, premošćivanju od bogova do Boga, Gučetić prolazi tragovima autoriteta iz dobro mu znane filozofske tradicije, opredjeljujući se ipak već i samim podnaslovom za promišljanje ljubavi »u Platonovu duhu«.Ovaj rad otkriće žene prezentirano kroz ženski glas dovodi u vezu s Gučetićevim stavovima iznesenim u Upravljanju obitelji, djelu objavljenom desetak godina nakon Dijaloga o ljepoti i Dijaloga o ljubavi. Poseban naglasak stavljen je na Gučetićevo tematiziranje pojma ljubavi i snagu argumenata korištenih u rješavanju zagonetke moći, izvorišta i kompleksnosti ljubavi.The vigorousness of Neo-Platonic conceptions and the revival of the ideals of antiquity, along with wholehearted support from Petrarchian lyricism, exalted women in Humanism and the Renaissance in a way which was inconceivable in the Middle Ages. The legislature of Dubrovnik, already under the prevalent influence of the Church, witnessed significant changes in the social positioning of women, while the novel intellectual orientations exerted powerful influence on its cultural life. Accordingly, it was in Dubrovnik that the first-ever poetesses emerged, and that the first-ever female myth was constructed; namely that of Cvijeta Zuzorić. The work of her contemporary and dear friend, Nikola Vitov Gučetić, bears witness to the then novel possibility – woman voice embedded in a philosophical concept, and promoted by the signature of this reputable citizen of Dubrovnik. Gučetić opened the doors of his villa, a sheltered place for »honourable study«, to two women for their talks of beauty and love, and dedicated the published Dialogues to yet another »respectable and most fair lady«, Cvijeta’s sister Nika. With this he gave his wife Maruša Gundulić and Cvijeta Zuzorić not only mediate voice, but also a name. In the stylistic encounter of the poetical and philosophical, in the interlacement of the actor and interpreter, in the bridging from gods to God, Gučetić traces the trails of authority from a well-known philosophical tradition, opting for a reflection on love »in the spirit of Plato« already in his subtitle.This paper unveils women presented via a feminine voice, and compares them with Gučetić’s attitudes articulated in his Upravljanje obitelji , a work published some ten years or so after his Dijalog o ljepoti and Dijalog o ljubavi . Close attention is given to Gučetić’s thematisation of the concept of love and the strength of arguments used in solving the mysteries of the power, source and complexity of love. (shrink)

In Tulving’s initial characterization, episodic memory was one of multiple memory systems. It was postulated, in pursuit of explanatory depth, as displaying proprietary operations, representations, and substrates such as to explain a range of cognitive, behavioural, and experiential phenomena. Yet the subsequent development of this research program has, paradoxically, introduced surprising doubts about the nature, and indeed existence, of episodic memory. On dominant versions of the ‘common system’ view, on which a single simulation system underlies both remembering and imagining, there (...) are no processes unique to memory to support robust generalizations with inductive potential. Eliminativism about episodic memory seems to follow from the claim that it has no dedicated neurocognitive system of its own. After identifying this under-noticed threat, we push back against modern eliminativists by surveying recent evidence that still indicates specialized mechanisms, computations, and representations that are distinctly mnemic in character. We argue that contemporary realists about episodic memory can retain lessons of the common system approach while resisting the further move to eliminativism. (shrink)

We live, according to some, in the century of biology, where we now understand ourselves in radically new ways as the insights of genomics and neuroscience have opened up the workings of our bodies and our minds to new kinds of knowledge and intervention. Is a new figure of the human, and of the social, taking shape in the 21st century? With what consequences for the politics of life today? And with what implications, if any, for the social, cultural and (...) human sciences? These are the issues that are discussed in this article, which argues that a new relation is requred with the life sciences, beyond commentary and critique, if the social and human sciences are to revitalize themselves for the 21st century. Pain asymbolia is a rare condition caused by brain damage, usually in adulthood. Asymbolics feel pain but appear indifferent to it, and indifferent also to visual and verbal threats. How should we make sense of this? Nikola Grahek thinks asymbolics’ pains are abnormal, lacking a component that make normal pains unpleasant and motivating. Colin Klein thinks that what is abnormal is not asymbolics’ pains, but asymbolics: they have a psychological deficit making them unresponsive to unpleasant pain. I argue that an (...) illuminating account requires elements of both views. Asymbolic pains are indeed abnormal, but they are abnormal because asymbolics are. I agree with Klein that asymbolics are incapable of caring about their bodily integrity; but I argue against him that, if this is to explain not only their indifference to visual and verbal threat, but also their indifference to pain, we must do the following: (i) take asymbolics’ lack of bodily care not as an alternative to, but as an explanation of their pains’ missing a component, and (ii) claim that the missing component consists in evaluative content. Asymbolia, I conclude, reveals not only that unpleasant pain is composite, but that its ‘hedomotive component’ is evaluative. (shrink)

The Galilean explanatory style is characterized by the search for the underlying structure of phenomena, the positing of "deep" explanatory principles, and a view of the relation between theory and data, on which the search for "crucial data" is of primary importance. In this paper, I trace the dynamics of adopting the Galilean style, focusing on the science of episodic memory. I argue that memory systems, such as episodic and semantic memory, were posited as underlying competences producing the observable phenomena (...) of memory. Considered in idealized isolation from other systems, episodic memory was taken to underlay the ability of individuals to remember events from their personal past. Yet, in reality, memory systems regularly interact, standing in many-to-many relations to actual memory tasks and experiences. Upon this backdrop, I explore a puzzle about the increasing prominence of the notion of autonoetic consciousness in Tulving's theory of episodic memory. I argue that, contrary to widespread belief, the prominence is not best explained by the purported essential link between autonoetic consciousness and episodic memory. Rather, it is explained by the fact that autonoetic consciousness, hypothesized to uniquely accompany episodic retrieval, was considered a source of crucial data, predictable only from theories positing a functionally distinct episodic memory system. However, with the emergence of a new generation of theories, positing wider memory systems for remembering and imagination, the question of the relation between episodic memory and autonoetic consciousness has been reopened. This creates a pressing need for de-idealization, triggering a new search for crucial data. (shrink)

Following Theodor W. Adorno’s reading of architecture as a purposeful art, the article explores how the social dimension is inscribed into the purposes ascribed to architecture by establishing a relation between what Adorno calls a sense of architectural space and the distribution of the sensible as defined by Jacques Rancière. Considering Rancière’s understanding of the political dimension of different “regimes of art”, the article attempts to show how similar observations can be made regarding architecture. In the philosophy of memory, singularism is the view that episodic memories are singular mental states about unique personally experienced past events. In this paper, I present an empirical challenge to singularism. I examine three distinct lines of evidence from the psychology of memory, concerning general event memories, the transformation of memory traces and the minimized role temporal information plays in major psychological theories of episodic memory. I argue that singularist views will have a hard time accommodating this evidence, facing (...) a problem of transitional gradation. I then look at some potential consequences for the larger debate, highlighting the way in which singularism has featured in three important recent arguments in the philosophy of memory. (shrink)

The Hard Question of memory is the following: how are memory representations stored and organized so as to be made available for retrieval in the appropriate circumstances and format? In this essay, I argue that philosophical theories of memory should engage with the Hard Question directly and seriously. I propose that declarative memory is a faculty performing a kind of cognitive triage: management of information for a variety of uses under significant computational constraints. In such triage, memory representations are preferentially (...) selected and stabilized, but also systematically modified and integrated into generalized, model-like representational structures. Further, I propose a hybrid theory of remembering, which takes into account both the nature of the cognitive processes underlying remembering and the norms that govern representational success in relevant cognitive/epistemic contexts. This paper offers a modeling account of episodic representation. I argue that the episodic system constructsmental models: representations that preserve the spatiotemporal structure of represented domains. In prototypical cases, these domains are events: occurrences taken by subjects to have characteristic structures, dynamics and relatively determinate beginnings and ends. Due to their simplicity and manipulability, mental event models can be used in a variety of cognitive contexts: in remembering the personal past, but also in future-oriented and counterfactual imagination. This article explores interpersonal and human–computer interaction in the era of big data through the lens of Martin Buber’s relational ethics. Doing theory otherwise, it analyses the importance of other voices and speech through the case of digital assistants, questioning the implications of naming them ‘companions’. Following recent proposals to ascribe legal subjectivity to synthetic agents, the article explores the effects on agency, interaction with flesh-and-blood others and democracy in an attention economy enmeshed with technologies of behavioural manipulation powered by (...) users’ utterances that enable novel forms of social control by owners of the means of communication. Taking the ‘Fridays for Future’ movement as its starting point, this article conceptualizes and defends youth disobedience, understood as principled disobedience by legal minors. The article first argues that the school strike for climate can be viewed as civil disobedience. Then, the article distinguishes between various forms of youth disobedience. Building on the democratic rationale for civil disobedience, the remainder of the article argues that there is a special justification for youth disobedience. To show this, it argues that children are (...) wrongfully excluded from political participation and that principled law-breaking can be an important remedy to this exclusion. The upshot is that adults should engage seriously and leniently with youth disobedience. (shrink)

This essay investigates the notion of simulation and the role it plays in Kourken Michaelian's simulation theory of memory. I argue that the notion is importantly ambiguous and that this ambiguity may threaten some of the central commitments of the theory. To illustrate that, I examine two different conceptions of simulation: a narrow one (simulation as replication) and a broad one (simulation as computational modeling), arguing that the preferred narrow conception is incompatible with the claim that remembering involves the simulation (...) of past episodes. Investigating possible solutions, I suggest that, despite some relatively serious consequences, the theory may be better off subscribing to the broad notion of simulation. (shrink)

In this chapter, we examine the naturalist approach in the philosophy of memory through the lens of the simulation theory of memory. On the theory, episodic memory is a kind of constructive simulation performed by a functionally specialized neurocognitive system. Taking naturalism to be a kind of methodological stance characterized by a cluster of epistemic guidelines, we illustrate the roles these guidelines have played in the development of the theory. We show how scientific evidence has guided both the selection of (...) the research question and the initial elaboration of the theory. We demonstrate how such evidence has led the simulationist to reject a familiar, commonsense picture of memory. We also trace the recent radicalization of the theory, highlighting the simulationist's continual reflection on their concepts and assumptions. In the spirit of such reflection, we end by outlining some outstanding challenges for the theory. (shrink)

Mainstream news broadcasting pursues an authentication project, to bolster its claims to serious, weighty and factual news reporting. News review contributes to this project when it seeks to humanize front-stage news personnel. It moves away from the traditional, institutionalized concern with `authenticity-from-above' and works to generate `authenticity-from-below'. As an extreme instance of resistance to the `from-above' formulation, this article considers data from a televised UK weekday morning show, The Big Breakfast, and specifically its `review of the papers' slot. The show's (...) orientation is iconoclastic, from the establishment perspective on news, partly by its high degree of reflexivity about the television medium. Its main presenter, Johnny Vaughan, extrapolates from newsprint sources well beyond the conventional bounds of the review genre. He delivers a thoroughly performed, burlesque response to more and less trivial aspects of the day's print news. His stylized vocal and visual representations of figures in the news achieve a populist moral consensus, as a key process in constructing a `from-below' authenticity. Even in this thoroughly tabloidized and comic performance, the show retains a clear critical dimension, strikingly at odds with authorized modes of news and news review. (shrink)

This article explores contemporary biopolitics in the light of Michel Foucault's oft quoted suggestion that contemporary politics calls `life itself' into question. It suggests that recent developments in the life sciences, biomedicine and biotechnology can usefully be analysed along three dimensions. The first concerns logics of control - for contemporary biopolitics is risk politics. The second concerns the regime of truth in the life sciences - for contemporary biopolitics is molecular politics. The third concerns technologies of the self - for (...) contemporary biopolitics is ethopolitics. The article suggests that, in these events, human beings have become `somatic individuals': personhood is increasingly being defined in terms of corporeality, and new and direct relations are established between our biology and our conduct. At the same time, this somatic and corporeal individuality has become opened up to choice, prudence and responsibility, to experimentation, to contestation and so to a politics of `life itself'. In a recent paper, Cheng and Werning (2016) argue that the class of episodic memories constitutes a natural kind. Endorsing the homeostatic property cluster view of natural kinds, they suggest that episodic memories can be characterized by a cluster of properties unified by an underlying neural mechanism for coding sequences of events. Here, I argue that Cheng & Werning’s proposal faces some significant, and potentially insurmountable, difficulties. Two are described as most prominent. First, the proposal fails to satisfy an important (...) normative constraint on natural kind theorizing, not providing the requisite theoretical resources for arbitration between rival taxonomies of memory. Second, the proposal is in a direct tension with a foundational principle of the HPC view: the rejection of essentialism. This has far-reaching consequences, threatening to undermine the coherence of the proposal. (shrink)

The main aim of this paper is the critique of poststructuralist theory of art, and particularly thesis about the avant-garde peace of art as a kind of transgression. As a starting point of this critique, the ordinary language philosophy developed by American philosopher Stanley Cavell is used, particularly his film theory. While poststructuralist philosophy was developed around the notion of ideology, Cavell interprets film and arts in general around the notion of skepticism. While poststructuralism, because of thesis about avant-garde as (...) a kind of transgression within the field of ideology, is a kind of philosophy of negation, we point out that Cavell?s philosophy is a utopian theory of transcending of skepticism where avant-garde film has significant but not crucial place. Cavell?s thesis is used as a basis for re-thinking of modernism, which is in opposition to postmodernist turn realized by poststructuralism. nema. (shrink)

Статтю присвячено дослідженню категорії "кредитор останньої інстанції". Проаналізовано класичні інтерпретації "кредитора останньої інстанції" та теорії, на яких це поняття базується. Досліджено еволюцію теоретичних знань, а також проаналізовано практичний досвід. Спираючись на роботи провідних сучасних вчених, стаття має на меті обґрунтувати необхідність подальшого розвитку теорії проблеми "кредитора останньої інстанції", та висвітлити питання дискусії стосовно того, чи має стати Європейський Центральний Банк кредитором останньої інстанції. Аналіз точок зору вчених був необхідним для того, щоб зрозуміти різницю між "кредитором останньої інстанції" для банків та (...) для урядів, а також для того, щоб позначити переваги та недоліки для економічної стабільності у ЄС. Підкреслено головні аргументи вчених-дослідників, які підтримують або не підтримують роль Європейського Центрального Банку як кредитора останньої інстанції як для банків, так і для урядів. Epidemiological data suggest that previous infections can alter an individual's susceptibility to unrelated diseases. Nevertheless, the underlying mechanisms are not completely understood. Substantial research efforts have expanded the classical concept of immune memory to also include long‐lasting changes in innate immunity and antigen‐independent reactivation of adaptive immunity. Collectively, these processes provide possible explanations on how acute infections might induce long‐term changes that also affect immunity to unrelated diseases. Here, we review lasting changes the immune compartment undergoes upon infection and how (...) infection experience alters the responsiveness of immune cells towards universal signals. This heightened state of alert enhances the ability of the immune system to combat even unrelated infections but may also increase susceptibility to autoimmunity. At the same time, infection‐induced changes in the regulatory compartment may dampen subsequent immune responses and promote pathogen persistence. The concepts presented here outline how infection‐induced changes in the immune system may affect human health. (shrink)

Global sourcing largely occurs from so-called emerging markets and developing economies. In these contexts, substantial leverage effects for sustainability in supply chains can be expected by reducing adverse impacts on society and minimising related risks. For this ethical end, an adequate understanding of the respective sourcing contexts is fundamental. This case study of South Africa’s mining sector uses institutional theory and the notion of institutional uncertainty to empirically analyse the challenges associated with establishing social sustainability. The case study research is (...) informed by 39 semi-structured interviews with top management representatives and various state and non-state decision makers in SA. Our findings suggest that sustainability in the institutional field is mainly shaped by the Social and Labour Plan institution, induced by state actors and mining companies’ practices. However, four weakening factors were identified that adversely affect this regulative institution, drive institutional uncertainty and allow for mining companies’ gradual decoupling. Contrastingly, complementing pressures of non-state actors limit institutional uncertainty and push toward mainstreaming the stipulations of the institution. This study contributes to the business ethics literature by providing an in-depth exploration of institutional uncertainty’s drivers and barriers within an upstream SC setting and shedding light on multiple actors’ interplay and relevance in sector-wide sustainability. The findings are condensed into three main propositions as well as an analytical framework as a basis for follow-up research. This case study helps practitioners understand and manage complexity that results from actor plurality and institutional uncertainty in EMDEs. (shrink)
